The Appeals Chamber of the HACC has concluded its consideration of the Ministry of Justice’s appeal in the case against K.E. Kevorkian.

The court of first instance ordered the forfeiture to the state of property directly owned by K.E. Kevorkyan, namely:

 

- 5 properties;

 

- 2 vehicles;

 

- property rights to 2 trademarks;

 

- funds amounting to over 26,000 hryvnias;

 

- a 15% share in the authorised capital of the limited liability company ‘PERSHOSTOLICHNE’.

 

At the same time, the High Anti-Corruption Court refused to order the seizure of property which, in the claimant’s view, the individual holds indirectly through his wife.

 

Following the appeal proceedings, the panel of judges partially upheld the appeal lodged by the Ministry of Justice of Ukraine, quashed the High Anti-Corruption Court’s decision insofar as it dismissed the claim, and issued a new ruling on this point. Assets registered in the name of Kevorkyan K.E.’s wife were seized for the state’s benefit, namely 1/2 of:

 

- 60% of the shares in the authorised capital of LLC ‘SALES DEPARTMENT “HK”’ and ‘PUBLISHING HOUSE “HK”’;

 

- 30% of the shares in the authorised capital of LLC ‘HARPOL’;

 

- 100% of the shares in the authorised capital of LLC “HK Publishing House”

 

- 60% of the shares in the authorised capital of LLC “Main HK Publishing House”.

 

The remainder of the decision remains unchanged.

 

The ruling of the court of appeal came into force on the date of its adoption and is not subject to appeal by way of cassation.

 

Based on the totality of the circumstances established by the court, in accordance with the legislation of Ukraine, sanctions were imposed on the defendant (a citizen of Ukraine) in connection with his involvement in terrorist activities. Such activities consisted, in particular, of propagating the russian federation’s armed aggression against Ukraine through the dissemination of information aimed at supporting and justifying the criminal nature of the russian federation’s actions, publicly denying the criminal nature of its armed aggression, and promoting the ideology of the ‘russian World’.
